SERVICES OFFERED

Koinpack is a returnable and reusable packaging system provider based on a deposit and reward model.

 

In Koinpack App, You can purchase the products that are available in the list of products (“Product List”) and processing the payment in accordance with the instructions in the App and then resell it (“Reseller”) to the end customers (“Customer”).

 

As a Reseller, You also may collect the Customer’s data and the number of packaging/bottles that have been sold and returned by Customers.

 

By using this App, You are not only becoming a Reseller but also contribute to the protection of environment by reducing the amount of plastic sachet and pouch in Indonesia.

 

KOINPACK’S COMMITMENT

 

Koinpack is committed to:

• Provide Services in accordance with the Terms and Conditions herein;

• Provide information on the products availability, and the Customer Cashback’s amount;

• Protect Your personal data and privacy, as well as the Customer data (“Customer Data”) that you provided us through the App;

• Provide information on any changes or modifications to the App and new Services; and

• Provide information on any changes to the Terms and Conditions, including the Privacy Policy.

 

RISTRICTIONS ON USE

 

You agree to abide by all applicable terms and conditions, law and regulations in Your use of the Site and our Services. In addition, You agree that You will not do any of the following:

 

• register for more than one account, or register for an account on behalf of an individual other than Yourself or on behalf of any group or entity;

• post or otherwise make available content, or take any action on the App, that may constitute libel or slander or that infringes or violates someone else’s rights or is protected by any copyright or trademark, or otherwise violates the law;

• post or otherwise make available content that in the Company’s judgment is objectionable, such as content that is harmful, threatening, inflammatory, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or otherwise objectionable, or which restricts or inhibits any other person from using or enjoying the App, or which may expose the Company or users of the App to any harm or liability of any type;

• post or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, or any other form of solicitation;

• use the information or content on the App to send unwanted messages to any other user;

• impersonate any person or entity, or falsely state or otherwise misrepresent Yourself, Your age or Your affiliation with any person or entity;

• post or otherwise make publicly available on the App any personal or financial information of any third party;

• solicit passwords or personally identify information for commercial or unlawful purposes;

• use the App or our products and services in any manner that could damage, disable, overburden or impair the App;

• harvest or collect email addresses or other contact information of other users from the App by electronic or other means, including the use of automated scripts; or

• post or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

REGISTRATION AND ACCOUNT

 

To use the Services, You need to download the Application in Your smartphone and register to create user account and/or reseller (“Account”). Thus, You must complete the registration form by providing the requested data. Further we will verify the validity of the information that You provided and provide You access to Your Account once Your data is verified.

To create your Account and make use of the Services, You must have the legal capacity or at the minimum at the age of 18

 

In creating Your account, You agree to provide the true, current, complete and accurate information in the registration form which is necessary for purposes of availing of our Services. If any information You provide is untrue, inaccurate, nor current, or incomplete, we reserve the right to cancel Your registration, and restrict Your future use of this App and our Services.

 

COLLECTION AND USE OF PERSONAL DATA

 

It is important for You to know that the Services can only be provided if You agree to disclose Your name and phone number (“Personal Data”) which may be verified by Koinpack.

 

You expressly authorize Koinpack to use all necessary means to verify your identity (including sharing information, personal and non-personal, you have provided) with third parties (service provider and/or data controller) which have cooperation with Koinpack to deliver the Services.

The Privacy Policy is the integral part of these Terms and Conditions.

 

TRANSACTION

In order to sell the products from us, You can choose one of our input options below:

1. Scan QR Code;

2. Code Input; or

3. Product List.

After you choose the option You may proceed with the transaction with the Customer.

 

RETURNING OF PACKAGING

 

Customer may return the packaging/bottle of the products that Customer have purchased and returned by using the “Returning” feature, then You can choose one of the input options below:

 

1. Scan QR Code;

2. Code Input; or

3. Product List.

 

In the event that the label of the packaging is missing, damaged or unseen, You may only return the packaging by using the option Product List above.

 

When Customer returns the packaging of the products that Customer previously purchased, Customer will be entitled to Customer Cashback which we determine from time to time and can be seen directly in the App. Please refer to the CUSTOMER CASHBACK section below for further details on this.

 

Koinpack accepts any condition with the packaging/bottle (i.e., when bottle cap is missing) that the Customer returns to Reseller.

 

ONLINE ORDER

 

You can purchase the products to us through online order by choosing “Online Order” feature in the App.

 

If You order any product using this feature, You may choose it from the available Products List and continue the ordering process. Finally, it will be processed by Koinpack’s admin.

 

CUSTOMER CASHBACK

 

When Customer returns the packaging/bottle of the products that You purchased previously, we will give You rewards as can be seen in the Customer Cashback feature. You can check Your cashback in the dashboard of the App which will be updated from time to time in accordance with Your return of packaging initiatives.

 

MARKET SURVEY AND CUSTOMER

 

Koinpack may invite You to participate in the survey in relation to the Services and the products in the App or through our Reseller. Your participation is on voluntary basis.

 

RISTRICTIONS ON USE

 

By considering the RISTRICTIONS ON USE section, in any situation Koinpack, its affiliates, licensors, service providers, employees, agents, officers or directors be held responsible for any damages, including, but not limited to damages, and direct, indirect, foreseeable or unforeseeable damages, lost profits, consequential damages, physical and moral damages and the loss of data, damages to property and any other damages derived from or related to acts alien to us or of Your improper use or misuse of the Services and/or the App, being improper or misused understood as undue – without the statement being exhaustive – to the use of the same in contravention of the provisions of these Terms and Conditions, or of the current or future regulations that replace it.

 

Koinpack will not be held responsible, for reasons beyond its control including – but not limited to – events or factors of force majeure, regulatory or regulatory changes or sanctions, or if You cannot access the App and/or the Services.

 

If You encounter any quality problem or are unsatisfied with the products purchased, we recommend You approach the supplier of the brand of the product directly, whose information can be found on the label of the packaging.

 

Koinpack is not liable for any damages, including but not limited to both direct or indirect damages, losses, and physical illness,  resulting from the products, You agree to release Koinpack from any liability for the above-mentioned damages. 

 

The above mentioned does not imply in any way an early waiver of the rights that assist the consumer under Law Number 8 of 1999 on the Consumer Protection in Indonesia.

 

LIABILITY OF BREACH

 

You shall be liable for any loss or damage suffered by the Company and/or its users as result of:

• Your breach of these Terms and Conditions or any agreement that You have entered into pursuant to the App’s services;

• Your fraudulent use of the App; and

• Your provisions of inaccurate, false or fraudulent data.

 

INTELLECTUAL PROPERTY RIGHTS

 

The design, trademarks, service marks, and logos of the App (“Marks”), are owned by or licensed to the Company, subject to copyright and other intellectual property rights under the laws of Indonesia. You may not use, copy or distribute of any the Marks found on the App unless otherwise expressly permitted.

 

CANCELLATION, DISABLING OR SUSPENSION OF ACCOUNT

 

You will lose Your right to access and use the App, and consequently, Koinpack has the right to cancel, suspend or disable Your Account, in the following cases:

• If You use the App and the Services in violation of the provisions in these Terms and Conditions;

• If we have reasonable doubt to think that You have committed fraud against us or any other third party by means of the use of the Services, or any other benefits established by Koinpack; and/or

• If we have reasonable doubt to think that You have misused the Services, Cashback or any other benefits established by Koinpack.

MODIFICATION OF TERMS AND CONDITIONS

 

Koinpack reserves the right to make changes to these Terms and Conditions (“Updated Terms”) at any time. Unless the changes in the Terms and Conditions are for the legal or administrative reasons, the Company will provide reasonable advance notice before the Updated Terms become effective by posting the Updated Terms on the App.

 

Your use of the App after the effective date of the Updated Terms constitutes Your agreement to the Updated Terms. You should review these Terms and Conditions and any Updated Terms before using the App.

 

MISCELLANEUOS

 

In the event that any provision of these Terms and Conditions deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.

 

You agree that all documents or notices may be delivered to You electronically, through Your e-mail address provided upon registration. Accordingly, You recognize and acknowledge that it is Your sole responsibility to update the Company with Your current e-mail address and the Company shall not be liable for any claim of loss or damage for failure to receive notices.

Subject to applicable law, all disclaimers, indemnities and exclusions in these Terms and Conditions shall survive termination of this agreement.

Unless expressly agreed in writing otherwise, these Terms and Conditions set out the entire agreement between You and us with respect to Your use of the Site and supersedes any and all representations, communications and prior agreements (written or oral) made by You or us.

These Terms and Conditions are governed by and construed in accordance with the laws of Republic of Indonesia. All matters, claims or disputes arising out of or in connection with these Terms and Conditions, shall first be settled by parties in good faith and all efforts shall be exerted to settle the dispute or difference amicably. In the event that the parties are unable to settle the dispute or difference, any legal proceeding which may arise shall be submitted to the exclusive jurisdiction of the BANI Arbitration Center, to the exclusion of all other courts.

 

ACCEPTANCE

 

YOU CONFIRM HAVING READ AND UNDERSTAND AND AGREE TO THE FOREGOING TERMS AND CONDITIONS, BY ACCEPTING THESE TERMS AND CONDITIONS AND THE PRIVACY POLICY YOU SIGNIFY YOUR EXPRESS CONSENT IN ACCORDANCE WITH THE APPLICABLE LAWS AND REGULATIONS ON DATA PROTECTION AND PRIVACY IN INDONESIA. YOU AGREE TO HOLD THE COMPANY, ITS OFFICERS AND STAKEHOLDERS, FREE AND HARMLESS FROM ANY AND ALL LIABILITIES, DAMAGES, ACTIONS OR CLAIMS IN CONNECTION WITH THE IMPLEMENTATION OR PROCESSING OF PERSONAL DATA IN RELATION TO YOUR CONSENT OR AUTHORIZATION UNDER THESE TERMS AND CONDITIONS.
